Agreement to Terms

These Terms & Conditions ("Terms") govern your use of the Quest mobile application operated by Vanta Apps LLC ("Quest," "we," "us," or "our"). By accessing or using Quest, you agree to be bound by these Terms.

1. Eligibility

1.1 Age Requirement

You must be at least 18 years old to use Quest. By using Quest, you represent and warrant that you are at least 18 years of age.

1.2 Account Requirements

You must:

• Provide accurate and complete information
• Maintain the security of your account
• Be responsible for all activity under your account
• Notify us immediately of any unauthorized access

2. Description of Service

2.1 What Quest Provides

Quest is a curated dating experience platform that provides:

• Pre-planned date itineraries ("Quests") in your city
• Venue information, directions, and reservation details
• Partner connection features to share Quest experiences
• Quest preparation and tracking tools

2.2 What Quest Does NOT Provide

• Quest does NOT make reservations on your behalf (you are responsible for booking venues)
• Quest does NOT provide transportation (we provide directions via Apple Maps)
• Quest does NOT guarantee venue availability, quality, or pricing
• Quest does NOT operate, control, or endorse any venues featured in Quests

3. User Accounts

3.1 Account Creation

To use Quest, you must:

• Create an account using your phone number
• Provide your name and location
• Accept these Terms and our Privacy Policy

3.2 Account Security

You are responsible for:

• Maintaining the confidentiality of your account
• All activities that occur under your account
• Notifying us immediately of any security breach

3.3 Account Termination

We reserve the right to suspend or terminate your account if:

• You violate these Terms
• You provide false information
• You engage in fraudulent or illegal activity
• We discontinue the service

You may delete your account at any time through the app settings.

4. Purchases and Payments

4.1 Quest Purchases

• Individual Quests may be purchased for a one-time fee
• Season Passes may be purchased for access to multiple Quests
• All purchases are processed through Apple's in-app purchase system
• Prices are subject to change without notice

4.2 Payment Processing

• All payments are processed by Apple
• We do not store or have access to your payment information
• Apple's payment terms apply to all transactions
• You are responsible for all charges, including applicable taxes

4.3 Refund Policy

• Where required by law
• In cases of technical errors that prevent access to purchased content
• At our sole discretion on a case-by-case basis

To request a refund, contact hello@vantaapps.com within 7 days of purchase with:

• Order details
• Reason for refund request
• Description of any issues

4.4 Season Pass Terms

• Season Passes grant access to specified Quests for a defined period
• Season Passes are non-transferable
• Season Pass pricing and included Quests may change for future purchases
• Active Season Passes will retain access to Quests available at time of purchase

5. User Conduct

5.1 Prohibited Activities

You agree NOT to:

• Violate any laws or regulations
• Harass, abuse, or harm other users
• Impersonate any person or entity
• Use Quest for commercial purposes without authorization
• Share your account with others
• Attempt to hack, reverse engineer, or compromise the app
• Use automated systems (bots, scrapers) to access Quest
• Post offensive, inappropriate, or harmful content
• Collect information about other users without consent

5.2 Content Standards

Any content you provide (profile photos, feedback, etc.) must:

• Be accurate and truthful
• Not violate intellectual property rights
• Not contain illegal, offensive, or inappropriate material
• Not include personal information of others without consent

5.3 Partner Interactions

When connecting with a partner on Quest:

• Treat others with respect
• Do not share personal information outside the app without consent
• Report any inappropriate behavior to hello@vantaapps.com
• Understand that Quest is not responsible for user interactions

6. Intellectual Property

6.1 Our Content

All content in Quest, including:

• Quest itineraries and descriptions
• Images, graphics, and design elements
• Text, logos, and trademarks
• Software code and functionality

is owned by Vanta Apps LLC or our licensors and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable license to:

• Access and use Quest for personal, non-commercial purposes
• View and use Quest content as intended within the app

You may NOT:

• Copy, modify, or distribute our content
• Create derivative works
• Remove copyright or trademark notices
• Use our content for commercial purposes

6.3 User Content

By uploading content to Quest (profile photos, reviews, etc.), you grant us:

• A worldwide, non-exclusive, royalty-free license
• To use, display, and distribute your content within Quest
• For the purpose of operating and improving the service

You retain ownership of your content and can delete it at any time.

7. Third-Party Venues and Services

7.1 Venue Relationships

Quest features third-party venues (restaurants, activities, etc.). We:

• Do NOT own, operate, or control these venues
• Are NOT responsible for venue quality, availability, or pricing
• Do NOT guarantee venue experiences
• Are NOT liable for issues at venues
• Do NOT endorse or warrant the safety of any venue
• Have NO control over venue operations, staff, or conditions

7.2 Reservations

You are responsible for:

• Making all reservations directly with venues
• Confirming availability and pricing
• Adhering to venue policies and requirements
• Any costs or fees charged by venues
• Verifying venue safety and suitability
• Complying with all venue rules and regulations

7.3 Venue Changes

Venues may:

• Change hours, pricing, or offerings without notice
• Close temporarily or permanently
• Modify policies or requirements
• Discontinue services featured in Quests

Quest is not responsible for venue changes and will update Quest information on a best-effort basis. We make no guarantees about the accuracy, currentness, or completeness of venue information.

7.4 Assumption of Risk

• Visiting third-party venues
• Participating in activities featured in Quests
• Food and beverage consumption
• Physical activities (hiking, climbing, sports, etc.)
• Transportation to and between venues
• Weather conditions and outdoor activities
• Interactions with venue staff and other patrons

You voluntarily assume all such risks and release Quest from any liability related to these activities.

8. Safety and Personal Responsibility

8.1 Personal Safety

You are solely responsible for:

• Your personal safety during Quests
• Choosing safe venues and activities
• Assessing risks before participating
• Taking appropriate safety precautions
• Emergency preparedness
• Medical fitness for activities
• Informing others of your whereabouts

8.2 User Interactions and Relationships

Quest provides curated experiences for couples and individuals. However:

• We do NOT screen, vet, or verify users
• We do NOT conduct background checks
• We are NOT responsible for user behavior or conduct
• We do NOT guarantee relationship outcomes or compatibility
• We do NOT mediate disputes between users or partners

• Your interactions with other Quest users
• Your relationship decisions and dynamics
• Reporting concerning behavior to appropriate authorities
• Your personal safety and wellbeing during Quests

8.3 Safety Recommendations

We encourage all users to:

• Share your Quest itinerary with a trusted friend or family member
• Keep your phone charged during your Quest
• Trust your instincts - if something feels unsafe, leave
• Arrange your own safe transportation to and from venues
• Be aware of your surroundings at all times
• Comply with all local laws and regulations
• Drink responsibly if consuming alcohol

8.4 Medical and Physical Fitness

Certain Quests may involve:

• Physical activities (hiking, sports, climbing)
• Alcohol consumption
• Food/allergen exposure
• Extended walking or standing

• Assessing your medical fitness for activities
• Disclosing allergies or dietary restrictions to venues
• Drinking responsibly
• Taking necessary medications
• Seeking medical attention if needed

Quest is not liable for any injuries, illnesses, or medical conditions arising from Quest activities.

8.5 Emergencies

In case of emergency:

• Call 911 or local emergency services immediately
• Quest does not provide emergency assistance or monitoring
• We are not responsible for response times or outcomes
• You are responsible for your own emergency preparedness

8.6 Release of Liability

• Personal injury or death
• Property damage
• Emotional distress
• Financial loss
• Relationship disputes
• Incidents at third-party venues
• Transportation accidents
• Food-borne illness or allergic reactions
• Any other harm arising from Quest use

This release applies to the fullest extent permitted by law.

9. Disclaimers

9.1 Service "As Is"

QUEST IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING:

• Warranties of merchantability or fitness for a particular purpose
• Guarantees of uninterrupted or error-free service
• Guarantees of venue quality or availability
• Accuracy of information

9.2 No Professional Advice

Quest does not provide:

• Relationship advice or counseling
• Medical, legal, or financial advice
• Professional recommendations
• Safety guarantees or certifications

9.3 Venue Information

All venue information is provided for informational purposes only. We:

• Do NOT guarantee accuracy of venue details
• Do NOT verify venue credentials or certifications
• Do NOT inspect or approve venues
• Update information on a best-effort basis only

10. Limitation of Liability

10.1 Exclusion of Damages

TO THE MAXIMUM EXTENT PERMITTED BY LAW, VANTA APPS LLC SHALL NOT BE LIABLE FOR:

• Indirect, incidental, special, or consequential damages
• Loss of profits, revenue, or data
• Personal injury or property damage
• Damages arising from use of Quest or third-party venues
• Damages from user interactions or relationships

10.2 Maximum Liability

Our total liability for any claim related to Quest shall not exceed the amount you paid to us in the 12 months prior to the claim, or $100, whichever is greater.

10.3 State Variations

Some states do not allow limitation of certain warranties or damages. In such states, our liability is limited to the greatest extent permitted by law.

11. Indemnification

You agree to indemnify, defend, and hold harmless Vanta Apps LLC, its officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

• Your use of Quest
• Your violation of these Terms
• Your violation of any rights of others
• Your conduct or interactions with other users
• Your experiences at third-party venues

12. Dispute Resolution

12.1 Governing Law

These Terms are governed by the laws of the State of Arizona, without regard to conflict of law principles.

12.2 Informal Resolution

Before filing a claim, you agree to contact us at hello@vantaapps.com to attempt informal resolution.

12.3 Arbitration Agreement

You and Vanta Apps LLC agree that any dispute arising from these Terms or Quest will be resolved through binding arbitration, rather than in court, EXCEPT:

• Small claims court disputes (under $10,000)
• Intellectual property disputes
• Disputes seeking injunctive relief

• Conducted under the American Arbitration Association (AAA) rules
• One arbitrator will decide the dispute
• Arbitration will be held in Phoenix, Arizona or remotely
• Each party pays their own costs unless the arbitrator decides otherwise
• The arbitrator's decision is final and binding

You agree that disputes will be resolved individually, NOT as a class action, and you waive your right to participate in a class action lawsuit.

12.4 Venue

If arbitration does not apply, you agree that any lawsuit must be filed in state or federal courts in Maricopa County, Arizona.

13. Communications

13.1 Electronic Communications

By using Quest, you consent to receive electronic communications from us, including:

• Push notifications
• Service announcements
• Updates to Terms or Privacy Policy
• Promotional messages (you can opt out)

13.2 Opt-Out

You can opt out of promotional communications by:

• Adjusting notification settings in the app
• Adjusting device notification settings
• Contacting hello@vantaapps.com

You cannot opt out of service-related communications.

14. Changes to Terms

14.1 Modifications

We reserve the right to modify these Terms at any time. We will notify you of material changes by:

• Posting updated Terms in the app
• Sending a push notification
• Updating the "Last Updated" date

14.2 Acceptance of Changes

Your continued use of Quest after changes constitutes acceptance of the updated Terms. If you do not agree to changes, you must stop using Quest and delete your account.

15. General Provisions

15.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Vanta Apps LLC regarding Quest.

15.2 Severability

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect.

15.3 Waiver

Our failure to enforce any provision does not waive our right to enforce it later.

15.4 Assignment

You may not assign or transfer these Terms. We may assign our rights and obligations to any party.

15.5 No Third-Party Beneficiaries

These Terms do not create rights for any third parties.

15.6 Force Majeure

We are not liable for delays or failures due to circumstances beyond our reasonable control (natural disasters, pandemics, government actions, etc.).

16. Apple-Specific Terms

16.1 Acknowledgment

You acknowledge that:

• These Terms are between you and Vanta Apps LLC, not Apple
• Apple has no obligation to provide support for Quest
• Apple is not responsible for the app or content
• Apple is a third-party beneficiary of these Terms

16.2 App Store Terms

Your use of Quest is also subject to Apple's App Store Terms of Service.
